Protezione internazionale in Italia
La protezione internazionale in Italia è concessa a quelle persone che hanno subito una persecuzione e/o un timore fondato di essere perseguitate nel loro Paese di origine per motivi di razza, religione, nazionalità, opinione politica, appartenenza ad un determinato gruppo sociale e che non possono ricevere protezione dal loro Paese di origine. Inoltre, è concessa anche a colori i quali, pur non essendo rifugiate, corrono effettivamente il rischio di subire nel Paese di origine un grave danno (condanna a morte, tortura, trattamento inumano o degradante, pericolo di morte a causa di un conflitto armato).
La protezione internazionale garantisce innanzitutto il diritto a non essere rimpatriato e a soggiornare e lavorare in Italia. Di regola, il Paese competente a valutare la domanda di protezione internazionale è il primo Paese europeo in cui si entra. Per ottenere la protezione occorre presentare una richiesta presso la Questura o la Polizia di Frontiera, compilando un modulo specifico di registrazione per la domanda di protezione internazionale.
Di seguito si svolgerà un colloquio, anche con l’ausilio di un traduttore per utilizzare la propria lingua madre ed, eventualmente, di un legale di fiducia, presso la Commissione Territoriale competente enunciando le esperienze vissute nel proprio Paese o Regione di origine ed i timori in caso di rientro nello stesso.
E’, inoltre, consigliabile farsi assistere da un legale di fiducia anche per presentare, prima del colloquio, una memoria illustrativa della propria posizione e ragioni della richiesta, che può essere redatta anche in lingua inglese.
HOW TO OBTAIN INTERNATIONAL PROTECTION IN ITALY
International protection is granted in Italy to persons who have suffered persecution and/or a well-founded fear of being persecuted in their country of origin on grounds of race, religion, nationality, political opinion, belonging to a particular social group and who cannot receive protection from their country of origin.
In addition, it is also granted to those who, although not refugees, are actually at risk of suffering serious damage in the country of origin (death sentence, torture, inhuman or degrading treatment, danger of death due to an armed conflict). First of all, international protection guarantees the right not to be repatriated and to stay and work in Italy.
As a rule, the country in charge to assess the application for international protection is the first entered European country. In order to obtain protection, a request to the Police Headquarters or the Border Police has to be submitted by filling in a specific registration form in order to apply for international protection.
Eventually an interview will take place, the help of a translator could be provided, in case of need, to give the option of speaking the native language and, possibly, a trusted lawyer, at the competent Territorial Commission stating the experiences lived in the country or region of origin and the fears in case of returning to it.
In addition, it is advisable to seek the assistance of a legal rappresentative also in order to present, before the interview, an explanatory statement of the situation and the reasons for the request, which may also be drawn up in English.
